Judiciary Bends The Rules To Imprison Female Journalist PDF Print E-mail

A letter dated 24th November, 2009, written by the Master and Registrar of the High Court, Mr. Elwyn Bailor, and addressed to female journalist, Mrs. Manjia Balema Samba, has clearly exposed the Sierra Leone Judiciary for what it is; a place which has one law for some people and another for other people.

As also a place of sentiments where it is alleged Honourable Lordships like members of a secret society, gang up together to fight against whosoever stands on their way. A place where right is wrong and wrong is right.

The letter was a response to Mrs. Samba's complaint against Magistrate Komba Kamanda who sent her to prison for one night on the 23rd July, after he committed her mater on a contempt allegation, to the High Court.

In paragraph 6 of the letter, Mr. Bailor said: "On the whole, the investigation into your complaint has showed no wrong doing by the Magistrate".

But in paragraph 4 of the same letter, it shows a clever admittance of the Master that the rules can be bent to suit the Judiciary's liking.

He said: "the procedure is that after committal, in the interim, you had to be remanded, this is what happened. An investigation shows that this was for one night".

This is totally untrue considering that highway robbers who are on bail are still granted bail on the days of the committal of their cases to the High Court.

Talking from the two sides of his lips, the Master told Mrs. Samba to appeal to the same Judiciary which sent her to prison claiming, "the Judiciary remains committed to dispensing justice in a fair and equitable manner".

Mrs. Samba it would seem stands no chance in hell to win a matter against a member of that claimed Judiciary club.

The Judiciary wants rebranding, but it will never get it until it makes up its mind to dispense justice as it should be seen.

It was as if that was almost 100% responsible for triggering the brutal and ruthless rebel war 19 years ago, according to the TRC reports, so the Judiciary has a lot of work to do to shake off such a stigma.
